Factual Profile: Quakertown Police Leadership and the February 20 Incident

My Original Report:

Scott McElree is the only town manager in Bucks County who is also police chief. He handles public records requests, too.

The potential lawsuits against him and the Borough of Quakertown could be enormous. Allegations of failing to identify himself, not wearing a uniform, using force against minors, and detaining them for days could expose the municipality to significant civil liability. The financial and legal consequences may be substantial.

I’ve been involved in investigating similar cases, and the conduct described are likely federal civil rights violations. I’m not sure how many children were involved but I’m guessing there are multiple counts.

There may be one small piece of good news here. When I investigated a similar case in Doylestown involving an adult who was tased multiple times without justification, the officer was represented by the union, and the additional legal protections significantly increased costs to taxpayers. Then, it hit me… he’s the Chief… he’s not in the union.

CONCLUSION

The best outcome for everyone involved would likely be for him to resign and for the Borough to reach a prompt settlement with the plaintiffs.

I have not even begun to calculate the financial exposure associated with this occurring during a publicly announced peaceful protest. Having worked with First Amendment litigation, I can say that the cost of defending this type of conduct would likely be substantial.

In addition, the District Attorney has launched an investigation into potential criminal charges, which further increases the legal and financial risks facing the Borough.

UPDATE

I wanted to wait for the evidence before framing it politically, but this very clearly appears to rise to the level of a hate crime, along with multiple civil liberties violations. There are already quite a few ACLU lawyers involved, and it looks systemic across the entire Quakertown Police Department. Since the Chief is also the Town Manager, this could indicate a borough-wide conspiracy coming under scrutiny. The scope of potential crimes is staggering, making it all the more critical that justice is served. Some of these violations could carry many years in prison— attacking and jailing kids? The evidence is brutal.

I first became aware of the attack on the morning of February 21. I obtained a video of the incident and was able to verify its authenticity within an hour. The footage shows an adult male charging into a group of children participating in a peaceful anti-ICE protest in Quakertown, PA. Initially, it was unclear who the individual was—he was seen wearing a brown shirt and violently placing a protester in a chokehold, appearing to act as a counter-protester.

Several hours later, further investigation revealed the male to be Scott McElree, the Chief of Police. After this identification, the investigation progressed more quickly, as a significant amount of publicly available information became accessible. It is important to note that decades of experience in investigative journalism were essential in accurately documenting and analyzing this incident.
