The Trump administration recently repealed the bedrock scientific finding that greenhouse gases threaten human life and the environment, effectively ending the federal government’s legal authority to regulate the pollution that is dangerously heating the planet.

While this move is deeply concerning, there are several reasons for cautious optimism. Most U.S. states already recognize the reality of climate change and continue to enforce regulations aimed at reducing emissions, with California leading the way. Automakers, for instance, must still meet the standards of the largest markets, as well as other states that maintain sensible regulations.

More importantly, science itself cannot be overruled. The latest action relied on a “secret report” produced by a federal advisory panel — a process that a federal court has now ruled unlawful. Environmental organizations such as Earthjustice and the Sierra Club have announced plans to sue, arguing that the rollback ignores decades of overwhelming scientific evidence.

1. Federal Judge Declares the Secret Panel Unlawful

The U.S. District Court ruled that the Department of Energy’s formation of the clandestine “Climate Working Group” violated the Federal Advisory Committee Act (FACA). FACA requires federal advisory panels to operate transparently, include balanced viewpoints, and maintain public records — none of which were met. Instead, the panel operated behind closed doors, excluding critical voices and public oversight.

2. The Secret Report Fueled Harmful Policy Actions

This covert report was used by the Trump administration to challenge the EPA’s Endangerment Finding, a foundational legal determination that greenhouse gases threaten public health and can be regulated under the Clean Air Act. The report, authored by a small group of climate skeptics, was cited to justify the rollback of vital climate protections, putting both public health and the environment at risk.

3. Global Implications — China Moves Ahead

Meanwhile, China is surging ahead of the U.S. in climate change mitigation. Recent reports indicate that China’s greenhouse gas emissions have entered a “flat or falling” phase, potentially signaling that the world’s largest polluter is approaching its emissions peak years ahead of its official 2030 target. This trend could propel China into a leadership position in global climate policy, leaving the U.S. further behind if federal action remains stalled.

BYD is a prime example — they outsold Ford globally in 2025. Meanwhile, under the Trump administration, Ford is reportedly planning to shift its EV manufacturing to the EU in partnership with China’s Geely Automobile Holdings Ltd.

Everything he touches turns to dust — definitely not a Midas touch. Ironically, his actions are doing the exact opposite of his promises. Inflation is rising, in part due to climate-related impacts. Manufacturing is leaving because of anti-science policies and rhetoric. The U.S. faces a massive brain drain, with top talent either leaving or choosing not to come. Combined with white nationalist policies, including anti-immigration measures, it’s unlikely the U.S. will ever reclaim its “king of the hill” status.

Bottom line: While the federal rollback is alarming, state-level regulations, judicial oversight, and international competition in climate mitigation create checks and balances that will continue to shape emissions trajectories. The science remains clear, and the law is increasingly on the side of climate accountability.
